Dans l’entendement de Macky Sall et compagnie, «constituent des actes terroristes punis de la réclusion criminelle à perpétuité, lorsqu’ils sont commis intentionnellement en relation avec une entreprise individuelle ou collective ayant pour but d’intimider une population, de troubler gravement l’ordre public ou le fonctionnement normal des institutions nationales ou internationales, de contraindre un gouvernement ou une organisation internationale à accomplir ou à s’abstenir d’accomplir un acte quelconque la terreur, les attentats et complots, les crimes commis par la participation à un mouvement insurrectionnel, les violences et voies de fait commis contre les personnes et les destructions ou dégradations commises lors d’un rassemblement, les enlèvements et séquestrations, les menaces, les infractions liées aux technologies de l’information et de la communication. »
Sur les sanctions, le président de la République voudrait que soit puni d’un emprisonnement d’un à cinq ans et d’une amende de 500 000 à 2 000 000 F CFA, « celui qui fait l’apologie des actes visés. » Il s’agit de toute personne qui recrute une autre personne pour faire partie d’un groupe ou pour participer à la commission d’un acte terroriste, est punie de la réclusion criminelle à perpétuité, toute personne qui fournit ou propose de fournir des armes à un groupe, à un membre d’un groupe ou à toute autre personne pour sa participation à la commission d’un acte terroriste, est punie de la réclusion criminelle à perpétuité. Ou encore, toute personne qui, en dehors des infractions prévues par la législation en vigueur à la lutte contre le blanchiment de capitaux et le financement du terrorisme, fournit un appui à un groupe, à un membre d’un groupe ou à toute autre personne, pour sa participation à la commission d’un acte terroriste, est punie de la réclusion criminelle à perpétuité. Celui qui distribue ou met à la disposition du public un message dans l’intention d’inciter à la commission d’un acte terroriste, en fait également partie. Et il est puni de la réclusion criminelle à perpétuité lorsqu’il y a un risque qu’un ou plusieurs de ces actes soient commis.
Des peines allant de 5 à 10 ans de prison et des amendes de 500 000 à 2 000 000 F CFA
Toujours, sont également punis d’un emprisonnement de 5 à 10 ans et d’une amende de 500 000 à 2 000 000 F CFA, «ceux qui ont sciemment recelé une personne qu’ils savaient avoir commis un acte terroriste, qu’ils savaient recherché de ce fait par la justice ou qui ont soustrait ou tenté de soustraire la personne poursuivie pour le même fait à l’arrestation ou aux recherches, ou l’ont aidée à se cacher ou à prendre la fuite» ; «ceux qui ne peuvent pas justifier de ressources correspondant à leur train de vie, tout en étant en relations habituelles avec une ou plusieurs personnes se livrant à un acte terroriste», entre autres. Des énoncés qui ont fait réagir l’opposition parlementaire. «Ces modifications visent fondamentalement à assimiler l’exercice du droit de manifester à du terrorisme (exemple : titre II article 279-1). Ceci est très grave et inacceptable. Nous allons dénoncer, avec le FRN, le M2D et toutes les forces vives de la nation cette forfaiture et cette attaque contre notre démocratie», avertit-elle.
Ainsi, à en croire l’opposition parlementaire, ce projet de loi est la pire de toutes les forfaitures. Reste maintenant à savoir pourquoi un projet aussi pernicieux a pu passer inaperçu.
